1.

Acceptance of Terms

By accessing and using the Inwardly application and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Inwardly app. Inwardly ("we," "us," or "our") reserves the right to modify these terms at any time, with notice provided as described in Section 19.

2.

Description of Service

Inwardly is a body awareness and interoception training application utilizing the Feel·Form·Data methodology. The app provides tools for users to log body awareness check-ins, capture interoceptive data through wearable device integration, and receive AI-generated insights based on their accumulated data and patterns.

Inwardly is offered during a limited beta program to a closed group of invited users. The service includes optional integration with wearable devices (WHOOP and Oura) and may include a coach or practitioner dashboard for account holders with extended permissions.

3.

Beta Program Terms

Inwardly is currently offered as a closed beta program. By using Inwardly, you acknowledge and agree to the following:

  • Invite-Only Access: Participation is limited to invited users only. Access may be revoked at any time at Inwardly's discretion.
  • User Capacity: The beta program is capped at approximately 100 active users.
  • Feature Changes: Features, functionality, and user interface may change, be removed, or be significantly modified without notice during the beta period.
  • No Uptime Guarantees: Inwardly makes no guarantee regarding service availability, uptime, or performance during beta. The service may be unavailable without notice.
  • Right to End Beta: Inwardly reserves the right to end the beta program at any time and to discontinue the service entirely.
  • No Support Obligations: Support may be limited or unavailable. Inwardly is under no obligation to provide technical support, bug fixes, or feature implementations during beta.

Use of Inwardly during beta is entirely at your own risk.

NOT a Medical Device

IMPORTANT DISCLAIMER: Inwardly does NOT provide medical advice, diagnosis, treatment, or any form of medical care. Inwardly is not a medical device and is not regulated by the FDA or any other medical authority. The app is designed for educational and wellness purposes only.

Inwardly's AI-generated insights, data analysis, and recommendations are not a substitute for professional medical advice. If you have any health concerns, symptoms, or conditions, you must consult with a qualified healthcare professional before taking any action based on information provided by Inwardly.

You use Inwardly at your own risk and assume full responsibility for any health decisions you make based on its content or features. Inwardly is not liable for any health outcomes resulting from your use of the app.

5.

User Accounts

To use Inwardly, you must create an account. Account creation and authentication are managed through Firebase. You agree to:

  • Maintain one account per person. Multiple accounts per user are not permitted.
  • Be at least 18 years of age to create and use an account.
  • Provide accurate, current, and complete information during registration.
  • Maintain the confidentiality of your password and account credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify Inwardly immediately of any unauthorized use of your account.

Inwardly may terminate your account if it believes you have violated these terms or if you provide false or misleading information.

6.

User Content

You retain ownership of all content you create, upload, or store in Inwardly, including body awareness check-ins, captures, notes, and personal data entries ("User Content").

License to Inwardly: By uploading User Content, you grant Inwardly a non-exclusive, worldwide, royalty-free license to use, store, and process your data for the purposes of:

  • Providing and improving the Inwardly service
  • Generating AI-powered insights specific to your account
  • Creating anonymized and aggregated data sets for product improvement and research
  • Training and improving AI models used in the app

Anonymized and aggregated versions of your User Content may be used by Inwardly for product development, analytics, and research purposes. Your personally identifiable information will not be shared with third parties without your explicit consent, except as described in our Privacy Policy.

7.

Wearable Device Integration

Inwardly may connect to third-party wearable devices and platforms, including WHOOP and Oura, through OAuth authentication. By connecting a wearable device, you agree to:

  • Third-Party Terms: You are subject to the terms of service and privacy policies of WHOOP (https://whoop.com/terms) and Oura (https://ouraring.com/terms). Please review those terms and policies independently.
  • Data Authorization: You authorize Inwardly to access your wearable device data through the platforms' OAuth systems.
  • No Responsibility for Third-Party Data: Inwardly is not responsible for the accuracy, completeness, or reliability of data provided by WHOOP, Oura, or other third-party devices. Data accuracy, synchronization issues, and device performance are the responsibility of the wearable device provider.
  • Disconnection: You may disconnect your wearable device from Inwardly at any time through your account settings. Disconnection will cease new data syncing but will not delete previously synced data from your Inwardly account.
8.

Privacy and Data

Your privacy is important to us. For detailed information about how we collect, use, and protect your data, and for specific information about wearable device data handling, please review:

No Advertising: Inwardly does not display advertisements, behavioral advertising, or use your data for advertising purposes.

No Data Sales: We do not sell, rent, or share your personal data with third parties for marketing or commercial purposes.

9.

Practitioner/Coach Dashboard

Some users may have access to a Practitioner or Coach Dashboard that allows them to view and interact with data from other users ("Clients"). The following terms apply:

  • Professional Relationship: Any professional relationship between a coach or practitioner and their client is a separate relationship between those two parties. Inwardly is not a party to that relationship.
  • Limited License: Coaches and practitioners receive a limited license to access client data solely for the purpose of coaching, guidance, or professional support as agreed between the coach and client.
  • Confidentiality Responsibility: Coaches and practitioners are responsible for maintaining the confidentiality of client data in accordance with their own professional obligations and applicable laws.
  • No Inwardly Responsibility: Inwardly is not responsible for how coaches or practitioners use or handle client data. Any disputes regarding coach-client relationships are the responsibility of the parties involved.
  • Termination of Access: If a coach or practitioner account is terminated, access to client data will be revoked immediately.
10.

Intellectual Property

Inwardly and all content within the app, including but not limited to the Inwardly application software, the Feel·Form·Data methodology, user interface design, text, graphics, logos, and any AI-generated insights, are the exclusive intellectual property of Inwardly or its licensors.

License to You: You are granted a limited, non-exclusive, non-transferable, revocable license to use Inwardly solely for personal, non-commercial purposes and in accordance with these terms.

Restrictions: You may not:

  • Copy, reproduce, or distribute any part of Inwardly without permission
  • Modify, create derivative works, or adapt the app
  • Reverse engineer, decompile, or attempt to discover the source code or underlying technology
  • Sell, license, or commercially exploit the app or its content
11.

AI-Generated Content

Many of the insights, recommendations, and analysis provided by Inwardly are generated by artificial intelligence. You acknowledge and agree that:

  • Not Medical Advice: AI-generated insights are not medical advice and do not constitute a diagnosis or treatment plan. They are generated for informational and educational purposes only.
  • Not Professional Opinion: AI-generated content is not the opinion or recommendation of a medical professional, licensed therapist, or qualified healthcare provider.
  • Potential for Errors: AI systems can make mistakes, misinterpret data, or provide inaccurate information. You should not rely solely on AI-generated insights without consulting qualified professionals.
  • Your Responsibility: You are responsible for evaluating AI-generated insights critically and consulting with appropriate professionals before taking any action based on them.
12.

Prohibited Uses

You agree not to use Inwardly in any manner that:

  • Violates any applicable law, regulation, or third-party right
  • Involves unauthorized access or "hacking" of Inwardly's systems
  • Reverse engineers, decompiles, or attempts to discover the source code or underlying technology
  • Scrapes, crawls, or automatically extracts data from the app
  • Uses automated tools or bots to interact with the service (except with explicit permission)
  • Impersonates another person or entity, or falsifies your identity
  • Harasses, abuses, or threatens other users
  • Transmits malware, viruses, or other harmful code
  • Attempts to interfere with or disrupt the app's functionality
  • Uses the service for harmful, illegal, or unethical purposes

Inwardly reserves the right to investigate and take legal action against users who violate these prohibitions.

13.

Subscription and Payment

Current Status: Inwardly is provided free of charge to all beta users.

Future Pricing: Inwardly intends to introduce pricing and subscription models in the future. Any future billing and payment terms will be communicated to users with appropriate notice and will be managed through RevenueCat or a similar platform.

Beta Guarantee: We guarantee that all current beta users will continue to have free access for the duration of the beta program. Any transition to paid services will be handled with advance notice.

14.

Termination

Termination by You: You may terminate your Inwardly account at any time by contacting support or using account settings. Upon termination, your data will be handled in accordance with our Privacy Policy.

Termination by Inwardly: Inwardly may terminate or suspend your account at any time, with or without cause, including but not limited to:

  • Violation of these Terms of Service
  • Engagement in prohibited activities
  • Inactivity or non-compliance with beta program requirements
  • Termination or end of the beta program
  • Technical, legal, or business reasons

Effect of Termination: Upon termination, your access to Inwardly will cease immediately. Your User Content will be handled in accordance with our data retention and deletion policies.

15.

Disclaimer of Warranties

INWARDLY IS PROVIDED "AS IS" AND "AS AVAILABLE." INWARDLY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Inwardly does not warrant that:

  • The app will be error-free or bug-free
  • The app will function without interruption or delays
  • AI-generated insights will be accurate, complete, or useful
  • Wearable device data will be synchronized accurately or in real-time
  • The app will meet your specific needs or expectations

This disclaimer is particularly important given Inwardly's beta status. Users should not expect the reliability, performance, or stability of a production application.

16.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INWARDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF INWARDLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Cap on Liability: Inwardly's total liability to you for any claim arising from these Terms of Service or your use of Inwardly shall not exceed the amount you have paid to Inwardly in the 12 months preceding the claim. During the beta period, since Inwardly is provided free of charge, this cap is effectively zero dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

17.

Indemnification

You agree to indemnify, defend, and hold harmless Inwardly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Inwardly
  • Your violation of these Terms of Service
  • Your User Content or how you use it
  • Your violation of any applicable law or third-party right
  • Any harm resulting from health decisions you make based on information provided by Inwardly
18.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Colorado for any disputes arising from these terms or your use of Inwardly.

19.

Changes to Terms

Inwardly may update these Terms of Service at any time. During the beta program, we commit to providing users with at least 7 days' written notice before material changes take effect. This shorter notice period reflects the rapid development pace of the beta program.

Your continued use of Inwardly following notice of changes constitutes your acceptance of the updated terms. If you do not agree to the changes, you must terminate your account.
